Terms of Service

1. Acceptance

By using EmitDream you agree to these terms. If you do not agree, do not use the service. You must be at least 13 years old to create an account.

2. Your Content

You own everything you create in EmitDream. We do not claim any rights to your memories, photos, voice memos, or any other content you store or transmit through the app. By storing content on EmitDream you grant us a limited, non-exclusive licence to host and transmit that content solely for the purpose of operating the service for you.

3. Acceptable Use

You may not use EmitDream to:

• Send harassment, hate speech, threats, or content that targets individuals based on protected characteristics.
• Transmit illegal content, malware, or content that violates another person's privacy.
• Upload or emit content that you do not have the right to share (including copyrighted material without licence).
• Attempt to circumvent our security controls, rate limits, or authentication.
• Scrape, crawl, or systematically extract data from the service.
• Use the service on behalf of minors under 13 without appropriate consent.

Violations result in immediate account suspension or termination at our discretion.

4. Copyright & DMCA

EmitDream respects intellectual property rights. If you believe content on our platform infringes your copyright, please send a DMCA notice to dmca@emitdream.com with: (a) identification of the copyrighted work; (b) identification of the infringing material and its location in the app; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury. We will respond promptly and remove infringing content where appropriate.

5. Digital Continuation Feature

EmitDream offers an optional "Digital Continuation" feature that, with your explicit opt-in consent, may use AI to continue your stream after your account becomes inactive. This feature:

• Is entirely opt-in — it is off by default and must be explicitly enabled in Settings.
• Only activates under conditions you define (e.g. extended inactivity period).
• Uses only content you have created and stored in your stream.
• Can be disabled or revoked at any time before activation.
• Does not use your content for training external AI models.

By enabling this feature you grant EmitDream a limited licence to use your stored content for this purpose under the conditions you specify.

6. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from Settings → Account → Delete Account. Account deletion permanently removes all your data from our systems.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for any loss of data or functionality due to outages, maintenance, or technical failures. We recommend using the export feature to maintain your own backup of important content.

8. Limitation of Liability

To the maximum extent permitted by law, EmitDream is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service.

9. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the app. Continued use after changes constitutes acceptance of the updated terms.
